Spend n Gain ID &/or other third party login identification as provided above are individually & collectively referred to the "Account Information".
You will be responsible for maintaining the confidentiality & security of the Account Information & are fully responsible for all activities that occur under Your Account. You agree to-
(a) Immediately notify Spend n Gain of any unauthorized use of Your Account Information or any other breach of security, &

REFUND POLICY

1. Refund policy only applicable for regular priced products only, not applicable for discount &/or campaign products.
2. Refund request issue needed to be raised within 3 (Three) days after getting products.

REPLACEMENT POLICY

1. If you find any kind of problems after receiving your product (i.e. physically damaged product/product does not function properly), you can receive replacement of your product (not applicable for discount &/or campaign products).
2. Customers can ask for a replacement of any product under certain conditions. All return requests must be made following Spend n Gain’s official customer support channel. Spend n Gain holds the right to replace or not to replace, customers based on its investigation as per company policy.
3. Customer has to login to their account and send a message to Spend n Gain team regarding their issues or complaints or they can email us directly at info@ spendngain.com; Spend n Gain "Customer Support Team" will get back to the customer within 7-10 working days after receiving and acknowledging a complain provided there is no force majeure issue.
4. In such cases pickup & delivery charge will be paid by customer.
5. Possible Scenarios in case of Replacements:

i. Damaged products: The buyer must provide Spend n Gain with images showing clearly the damage, and after all the verification we will arrange to pick the product up. All the labels must be intact, if not; the item won't be replaced in any way.
If that product is not available in Spend n Gain stock, customers can choose any product worth the same value and get the replacement within the standard delivery time.
No refund is applicable under any circumstances. ii. In the case of missing pieces: Follow the regular complaint lodging process and wait for verification of Spend n Gain customer support team. Upon successful verification, Spend n Gain will arrange to send the missing pieces following the standard delivery process. No replacement is applicable to such a case.  

Returns Pick-Up and Processing

During pick-up, your product will be checked for the following conditions: The field executive will refuse to accept the return if any of the above conditions is not met. Open box deliveries
Once you have accepted an open box delivery, no return request will be processed. এই Terms & Condition টি ক্রেতা ও বিক্রেতার মধ্যকার একটি চুক্তি বলে বিবেচিত হবে, যেখানে বিক্রেতা সাইটের সকল শর্ত মেনে তার পণ্য বিক্রির জন্য উপস্থাপন ও প্রস্তাব দিচ্ছেন এবং একই ভাবে ক্রেতা সকল শর্ত মেনে পণ্য ক্রয় এর ক্ষেত্রে সম্মতি জ্ঞাপন করছেন। ক্রেতার ক্ষেত্রে এই শর্ত সমূহ পণ্য সাইটে উপস্থাপন করার তৎপরবর্তী সময়ে প্রযোজ্য ও প্রয়োগ হবে।
এই Terms & Condition মোতাবেক একজন সম্মানিত সদস্য www.spendngain.com সাইট এর অধীনে পণ্য (নিম্নে বর্ণিত) Spend n Gain এর নাম ও শৈলী-তে ক্রয় করবেন।
যেকোনো পণ্য এর পূর্বে ক্রেতাকে এই Terms & Condition ভালভাবে পড়ে পণ্য ক্রয় এর জন্য অনুরোধ করা হল।
ক্রেতা এই Terms & Condition এর কোন অংশ/সম্পূর্ণ বিষয় এ সম্মত না হলে আমাদের সাইট থেকে পণ্য ক্রয় থেকে বিরত থাকার জন্য অনুরোধ করা হল।

ইউজার এগ্রিমেন্ট
এই নথিকে আমরা আমাদের অফিসিয়াল ব্যবহারকারী চুক্তি (Official User Agreement) বলে বিবেচনা করব। এই User Agreement এর অন্তর্গত সকল Terms & Condition এর মাধ্যমে Spend n Gain এর প্রতি আপনার অধিকার, সদস্য/ব্যবহারকারী হিসাবে সীমাবদ্ধতা ও দায়িত্ব অবহিত করা হল এবং সেই সাথে Spend n Gain এর অন্তর্গত সকল সাব-ডোমেইন (Sub-Domain), সাইট (Site), সার্ভিস (Service) এবং টুলস (Tools) এর জন্যও তা সমান ভাবে প্রযোজ্য হবে তা অবহিত করা হল, তাই এই নথিটি পুরোপুরি পড়ার জন্য অনুরোধ করা হল। এই সাইটটি ব্যবহার এর সাথে সাথে আপনি স্বয়ংক্রিয় ভাবে সকল শর্ত সমূহ পালন এর সম্মতি প্রদান করছেন বলে বিবেচনা করা হবে। আপনি সাইটটি ব্যবহার শুরু করা মাত্র ইউজার এগ্রিমেন্ট (User Agreement) এর শর্ত সমূহ পালন করতে শুরু করেছেন বলে বিবেচনা করা হবে। যদি আপনি তা তে অসম্মত হন তাহলে সাইটটি একসেস (Access) এবং রেজিষ্ট্রেশন (Registration) করা থেকে বিরত থাকুন।
ক) আপনার একাউন্ট
আপনি আমাদের সাইট এর একসেস (Access) এবং ব্যবহার করছেন একজন সম্মানিত সদস্য হিসেবে।
অপ্রাপ্তবয়স্ক (১৮ বৎসর এর কম বয়সী) কারও জন্য এই সাইটটি ব্যবহার এর অনুমতি নাই। সাইট এ অপ্রাপ্তবয়স্ক কোন ব্যবহারকারীকে Spend n Gain তথা তার মালিকানাধীন প্রতিষ্ঠান Be Yourself Ventures Limited যে কোন সময় নিষিদ্ধ বা একাউন্ট/রেজিষ্ট্রেশন বাতিল করে দেবার স্বত্ব সংরক্ষণ করে। যদি আপনি নিয়ম মোতাবেক এই সাইটটি ব্যবহার এর ক্ষেত্রে অযোগ্য বিবেচিত হন, সে সকল ক্ষেত্রে আপনি পরবর্তীতে এই সাইটটি আর ব্যবহার ও সেবা গ্রহণ করতে পারবেন না। তবে অপ্রাপ্তবয়স্ক যে কেউ তার অভিভাবক এর অনুমতি ও সাহায্য সাপেক্ষে সাইটটি ব্যবহার করতে পারবেন। সেক্ষেত্রে সম্পাদিত চুক্তিটি Spend n Gain ও অপ্রাপ্তবয়স্ক ব্যক্তির অভিভাবক এর মধ্যে সম্পাদিত হয়েছে বলে বিবেচনা করা হবে। Spend n Gain সাইট সেবা প্রদান এর লক্ষ্যে বিবিধ সেকশন তৈরি করেছে। আপনি প্রয়োজনীয় তথ্য প্রদান করে লগ-ইন আইডি (Login ID) এবং পাসওয়ার্ড (Password) এর মাধ্যমে "অ্যাকাউন্ট" (Account) তৈরি করে সাইটটি ব্যবহার করতে পারবেন। লগ-ইন আইডি (Login ID) এবং/অথবা উপরে প্রদত্ত অন্যান্য তথ্যাদি তৃতীয় পক্ষের লগ-ইন করার ক্ষেত্রে ব্যক্তিগতভাবে এবং সমষ্টিগতভাবে "অ্যাকাউন্ট তথ্য" (Account Information) হিসাবে বিবেচিত হবে।
আপনি অ্যাকাউন্টের তথ্যের গোপনীয়তা ও নিরাপত্তা বজায় রাখার দায়ীত্ব আপনার এবং আপনার অ্যাকাউন্টের অধীনে ঘটে যাওয়া সমস্ত ক্রিয়াকলাপের জন্য আপনি সম্পূর্ণরূপে দায়ী থাকবেন। এই মর্মে আপনি সম্মতি দিচ্ছেন-
১ আপনার অ্যাকাউন্ট এ অননুমোদিত ব্যবহার বা তথ্যের নিরাপত্তার লঙ্ঘিত হয়েছে এমন বিষয় অবিলম্বে অবহিত করুন, এবং
২ প্রতিটি সেশনের শেষে আপনি আপনার অ্যাকাউন্ট থেকে সঠিক ভাবে প্রস্থান (Exit) করেছেন বিষয়টি নিশ্চিত করুন। অন্যথায় আপনি আপনার অ্যাকাউন্টের তথ্য সুরক্ষিত ও গোপন রাখতে ব্যর্থ হলে তার দায় Spend n Gain এর নয়। এছাড়া আপনার অ্যাকাউন্ট এ অনুমোদিত বা অননুমোদিত ব্যবহারের কারণে Spend n Gain ওয়েবসাইটের কোন প্রকার ক্ষতি সাধন হলে তার জন্য আপনাকে দায়ী করা হতে পারে।
ওয়েবসাইট এ রেজিস্ট্রেশন ফর্মে দেয়া আপনার সকল তথ্য সম্পূর্ণ, নির্ভুল এবং আপ টু ডেট বিষয়টি নিশ্চিত করুন। ওয়েবসাইট এর সেবা গ্রহণের ক্ষেত্রে অন্য ব্যবহারকারীর অ্যাকাউন্ট এর তথ্য ব্যবহার করা স্পষ্টভাবে নিষিদ্ধ।
যদি আপনি এমন কোন তথ্য প্রদান করেন যা অসত্য, ভুল, বর্তমান নয় বা অসম্পূর্ণ (অথবা অসত্য, ভুল, বর্তমান নয় বা অসম্পূর্ণ হতে পারে) এছাড়া Spendngain এর সন্দেহ করার যুক্তিসঙ্গত কারণ আছে যে এই ধরনের তথ্য অসত্য, ভুল, বর্তমান নয় বা অসম্পূর্ণ এসকল ক্ষেত্রে বর্তমান বা ভবিষ্যতে Spendngain আপনার অ্যাকাউন্ট এবং ওয়েবসাইট/সেবা সাময়িক স্থগিত বা সম্পূর্ণরূপে বন্ধ করার (অথবা এর কোন অংশ) অধিকার সংরক্ষণ করে।
১ . প্রাইভেসি
আমাদের সদস্যদের তথ্যের গোপনীয়তা আমাদের সর্বোচ্চ অগ্রাধিকার। আমরা জানি আপনার ব্যক্তিগত তথ্য আপনার জন্য গুরুত্বপূর্ণ এবং এটি আমাদের জন্যও গুরুত্বপূর্ণ। আপনি যখন আমাদের সেবাগুলি গ্রহণ করেন তখন আপনার তথ্য কীভাবে ব্যবহার করা হয় তা আমাদের গোপনীয়তা নীতি (Privecy Agreement) এ বর্ণিত রয়েছে, যা প্রযোজ্য আইন ও প্রবিধান দ্বারা পরিচালিত। এরপরেও যদি আপনি অসম্মত হন তাহলে সাইটি ব্যবহার করা থেকে বিরত থাকুন।

সেই সাথে আমাদের পণ্য এবং সেবার ক্রমাগত উন্নয়ন করার জন্য, আমরা আমাদের ওয়েবসাইটে সদস্যদের কার্যকলাপ এর উপর ভিত্তি করে জনসংখ্যাতাত্ত্বিক এবং প্রোফাইল ডেটা বিশ্লেষণ করে থাকি।

যা আমাদের শর্তাবলী বা গোপনীয়তা নীতি প্রয়োগের জন্য যুক্তিসঙ্গতভাবে প্রয়োজনীয় এছাড়া তা আমাদের এবং জনস্বার্থে ও জনগন এর অধিকার এর সাথে সংশ্লিষ্ট।
এছাড়া আমরা ভোক্তার ব্যক্তিগত তথ্য অন্য কোন ব্যবসায়িক সত্ত্বার সাথে শেয়ার / বিক্রয় করব যদি আমরা সেই ব্যবসায়িক সত্ত্বার সাথে সংযোজন, ব্যবসা পুনর্গঠন বা একীভূত হওয়ার পরিকল্পনা করে থাকি। যদি এই ধরনের লেনদেন হয় তবে অন্য ব্যবসায়িক সত্ত্বা (অথবা নতুন সম্মিলিত সত্ত্বা) আপনার ব্যক্তিগত তথ্যের ক্ষেত্রে একই গোপনীয়তা নীতি অনুসরণ করবে। ২. অন্য সাইট এর সাথে সংযোগ

আপনার এবং Spend n Gain এর মধ্যে কোন প্রকার বিরোধ দেখা দিলে তা আলোচনা ও মধ্যস্থতার ভিত্তিতে নিষ্পত্তি করা হবে। অতঃপর যদি আলোচনা ও মধ্যস্থতার মাধ্যমে বিরোধ নিষ্পত্তি করা না যায় সেক্ষেত্রে দেশে প্রচলিত আরবিট্রেশন অ্যাক্ট ২০০১ এর আলোকে, একজন আরবিট্রেটর (বিরোধ নিষ্পত্তিকারী) এর মাধ্যমে ঢাকা, বাংলাদেশ এ বিরোধ নিষ্পত্তি করা হবে। ১৭. আইন ও এখতিয়ার

(Replacement Policy)

১. পণ্য গ্রহণ করার পর কোন প্রকার ত্রুটি পাওয়া গেলে রিপ্লেসমেন্ট পাওয়া যাবে (ফিজিকাল ড্যামেজ বা সঠিক ভাবে কাজ করছে না এমন), তবে ডিসকাউন্ট এবং/অথবা ক্যাম্পেইন প্রোডাক্ট এর ক্ষেত্রে প্রযোজ্য নয়।
২. রিপ্লেসমেন্ট এর জন্য নির্দিষ্ট কিছু শর্ত প্রযোজ্য। রিপ্লেসমেন্ট রিকোয়েস্ট Spend n Gain এর অফিসিয়াল কাস্টমার সাপোর্ট চ্যানেল এ দাখিল করতে হবে। প্রকৃত যাচাই-বাছাই এর পরে কোম্পানির নিয়ম অনুযায়ী Spend n Gain রিপ্লেসমেন্ট দেয়া বা না দেয়ার স্বত্ব সংরক্ষণ করার অধিকার রাখে।
৩. কাস্টমার তার একাউন্ট এ লগ ইন করে [email protected] এই ই-মেইল এ তাদের ই-মেইল করবেন। Spend n Gain কাস্টমার সাপোর্ট টিম ৭-১০ কর্ম দিবস এর মধ্যে আপনার সাথে যোগাযোগ করবে।
৪. এক্ষেত্রে পিক-আপ ও ডেলিভারি চার্জ কাস্টমার বহন করবেন।
৫. সম্ভাব্য রিপ্লেসমেন্ট প্রেক্ষাপট:

পিক-আপ করার সময়, আপনার পণ্যর নিম্নলিখিত শর্তগুলিপরীক্ষা করা হবে: উপরোক্ত শর্ত পূরণ না হলে ফিল্ড এক্সিকিউটিভ রিটার্ন গ্রহণ করতে অস্বীকার করতে পারবেন।
ওপেন বক্স ডেলিভারি (Open Box Delivery)
ওপেন বক্স ডেলিভারির ক্ষেত্রে, রিটার্নের কোন প্রকার অনুরোধ গ্রহন করা হবে না। এই টার্মস এন্ড কন্ডিশন ক্রেতা এবং বিক্রেতার মধ্যে একটি আইনগত চুক্তি বলে বিবেচিত হবে, যেখানে বিক্রেতা ওয়েবসাইটে এ পণ্য/পণ্যগুলি তালিকাভুক্ত করে বিক্রির প্রস্তাব দিচ্ছেন এবং ক্রেতা বিক্রেতার প্রস্তাব কে সমর্থন করে পণ্যটি কেনার জন্য সম্মতি দিচ্ছেন। ওয়েবসাইট এর এই শর্তাবলী ওয়েবসাইটে প্রদর্শিত এবং তালিকাভুক্ত সকল পণ্য এর ক্ষেত্রে কার্যকর হবে এবং ক্রেতা পণ্য কিনতে সম্মত হলে ক্রেতার উপর কার্যকর হবে।
